Privacy policy

This policy explains what personal information WINGOMART Gaming Chairs, the business operating gamingchairswm.com, collects, why we collect it, who we share it with, how long we keep it, and what you can ask us to do with it. It is written to meet Quebec's Act respecting the protection of personal information in the private sector, as amended by Law 25, and applicable Canadian privacy law.

Put "Privacy request" in the subject line and your message will be routed to that person.

What we collect

  • Contact and delivery details - your name, email address, shipping address, billing address, and a phone number if you give one.
  • Order information - what you bought, your order number, amounts and currency, order history, returns and warranty claims.
  • Payment information - handled by the payment provider you choose at checkout. We receive confirmation that the payment succeeded and limited details such as the card type and the last digits. We do not receive or store your full card number.
  • Account information - if you create an account: your login details and saved addresses.
  • Messages you send us - emails, support requests, reviews, and anything you attach, such as photos of a damaged chair.
  • Technical and usage information - IP address, browser and device type, pages viewed, and identifiers stored by cookies where you have accepted them.
  • Marketing preferences - whether you subscribed to our emails, and whether you unsubscribed.

Why we collect it

  • To take, process, ship and deliver your order.
  • To handle returns, refunds, exchanges and warranty claims.
  • To answer your messages and provide customer service.
  • To take payment and to prevent fraud and abuse.
  • To meet legal obligations, including tax, accounting and consumer-protection record keeping.
  • To keep the site working, secure and easier to use.
  • To send marketing emails, when you have agreed to receive them.

We do not use your personal information for a purpose that is not on this list without asking you first.

Consent

We collect and use this information with your consent, or where the law otherwise allows or requires it. You can withdraw your consent to marketing at any time, by using the unsubscribe link in any marketing email or by writing to us. Withdrawing consent does not affect records we are required to keep for orders you have already placed.

Who we share it with

We do not sell your personal information. We share it with the service providers we need in order to run the store, only for the purpose we engaged them for, and they act on our instructions:

  • Shopify - the e-commerce platform this store runs on. It hosts the site and processes order and customer data on our behalf.
  • Payment providers - the payment services offered at checkout, which process your payment and run their own fraud checks.
  • Shipping carriers - the name, address and contact details needed to deliver your parcel.
  • Email and support tools - to send order confirmations, shipping notices, and marketing emails if you asked for them.
  • Analytics and advertising providers - only where you have accepted those cookies through the banner on the site.

We may also disclose personal information where the law requires it - for example to answer a court order or a lawful request from a public authority - to establish or defend a legal claim, or to a buyer if the business is sold, in which case the information stays subject to this policy.

Cookies and the consent banner

Cookies are small files your browser stores. Some are strictly necessary: they keep your cart and your session working and remember your cookie choices. Others are optional: they measure how the site is used or support advertising.

The banner on the site lets you accept or refuse the optional cookies before they are set. You can change your choice at any time through the banner, and you can block or delete cookies in your browser settings. Blocking strictly necessary cookies will stop parts of the store, including checkout, from working properly.

How long we keep it

We keep personal information only as long as we need it for the purpose it was collected for, and for as long as tax, accounting and consumer-protection law requires us to keep the record - order records and warranty records in particular. After that we delete it or anonymise it. Support emails are kept while they remain useful for handling your file. Marketing lists are kept until you unsubscribe.

Information stored or processed outside Quebec

Some of our service providers, including Shopify, store or process personal information outside Quebec - elsewhere in Canada and in the United States. Before entrusting personal information to a provider outside Quebec, we assess whether it will receive adequate protection, and we require the provider to protect it under a written agreement.

Information held in another country can be subject to the laws of that country, including access by its courts and public authorities.

Security

We use reasonable technical and organisational measures to protect personal information and we limit access to the people who need it to do their work. No system is perfectly secure. If a confidentiality incident presents a risk of serious injury, we will notify the people concerned and the Commission d'accès à l'information du Québec, and we keep a register of incidents as the law requires.

Your rights

Under Quebec law you can ask us to:

  • Access - give you a copy of the personal information we hold about you, and tell you how it is used.
  • Rectify - correct information that is inaccurate, incomplete or ambiguous.
  • Withdraw consent - stop marketing, or withdraw consent to a use that is not needed to complete your order.
  • Stop dissemination or de-index - ask us to cease disseminating information about you, or to de-index a link to it, where the law allows.
  • Portability - receive the computerised personal information you gave us in a structured, commonly used technological format, or have it sent to another organisation.
  • Be informed about automated decisions - know if a decision about you was made using only automated processing, and have it reviewed by a person.

We do not currently make decisions about customers based exclusively on automated processing. If that changes, we will tell you at the time and you will be able to ask for a review.

To exercise a right, email contactus@wingomart.com. We may need to confirm your identity before we answer. We reply within 30 days. If our answer does not satisfy you, you may file a complaint with the Commission d'accès à l'information du Québec.

Children

This store is not aimed at children. Under Quebec law, personal information about a child under 14 may only be collected with the consent of a parent or guardian. If you believe we hold information about a child, write to us and we will delete it.

Changes to this policy

We may update this policy. The version in force is the one posted on this page, with its effective date at the top. If we make a significant change, we will make it visible on the site.
