Terms of service
Terms of service
Effective date: August 21, 2026
These terms apply when you use gamingchairswm.com or buy from it. They are written in plain language on purpose. Placing an order means you accept them.

Our full company details are on the Legal notice page.
Using this site
- You must be old enough to enter into a binding contract where you live.
- Give us accurate information, in particular your shipping address and email address.
- Do not use the site for an unlawful purpose, and do not try to disrupt it or reach another customer's information.
- Do not copy or scrape the site's content for commercial use without our written permission.
Products, prices and availability
All prices are in Canadian dollars. Applicable taxes are calculated and shown at checkout before you pay. Shipping charges, where they apply, are shown at the same time.
We describe our chairs, headsets and accessories as accurately as we can. Photographs and colours can look different on your screen than the item does in your room.
Prices, specifications and availability can change. If an item is out of stock, or a price or description on the site is wrong, we may cancel the affected order and refund it in full. We will tell you before we do.
What you are told before you buy
Because this is a distance contract, here is where each key term is disclosed to you before you commit:
- Our business name, address, telephone number and email address - on the Contact and Legal notice pages.
- A description of the product and its main characteristics - on the product page.
- The price, applicable taxes, shipping charges and the total in CAD - on the product page and at checkout.
- The shipping method and the delivery estimate - in our Shipping policy and at checkout.
- How to cancel, return an item and obtain a refund - in our Refund policy.
- The terms of the commercial warranty - on the Limited warranty page.
If any of that is unclear, email or call us before you order and we will answer.
Orders and acceptance
Your order is an offer to buy. The contract is formed when we confirm the order by email. We may decline or cancel an order - for example if the item is unavailable, if a price or description was wrong, if we cannot deliver to the address given, or if we have reasonable grounds to suspect fraud. If we cancel, we refund everything you paid for that order.
Payment
Payments are handled by the payment providers offered at checkout through Shopify, the e-commerce platform this store runs on. We do not see or store your full card number. By paying, you confirm you are authorised to use the payment method you chose.
Shipping and delivery
Orders placed before 2:00pm EST on a business day are processed the same day. Standard shipping is free everywhere in Canada with no minimum order, with a carrier estimate of 3 to 10 business days. Express is 1 to 3 business days at the rate shown at checkout. International shipping is available at paid rates, and duties and import taxes are the buyer's responsibility unless the checkout says otherwise. Estimates are not guaranteed delivery dates. Full details are in our Shipping policy.
Returns and refunds
You have 30 days from delivery to return an item that is unused and in its original packaging, with no restocking fee. Report anything damaged, wrong or missing within 7 days of delivery. The details are in our Refund policy.
Warranty
WINGOMART products carry a 1-year limited warranty from the date of original purchase against manufacturing defects in materials and workmanship. The complete terms, including what is excluded, are on the Limited warranty page, which is the authoritative document.
The legal warranty under Quebec law applies in addition to that commercial warranty. Nothing in these terms excludes, limits, replaces or shortens the legal warranty provided by the Consumer Protection Act and the Civil Code of Quebec, or any other right you hold as a consumer. We do not sell products "as is".
Our responsibility
We are responsible for delivering what you ordered, in the condition described, and for our own fault. To the extent the law allows, we are not responsible for indirect or consequential losses - such as lost time, lost profit or lost data - arising from your use of this site.
This section is expressly subject to applicable consumer-protection law. It does not limit our liability where the law does not permit it to be limited, including our obligations under the legal warranty and our liability for bodily or moral injury.
We do not ask you to indemnify us, and we do not ask you to assume risks or obligations that the law places on us as the seller.
The site itself
We work to keep the site available, accurate and secure, but we cannot promise it will be free of interruption or error. We may change, suspend or withdraw part of the site, or stop selling a product, at any time. That does not affect an order we have already accepted.
Content you send us
If you send us a review, a photo or a comment, you keep ownership of it and you give us permission to publish it on the site and in our marketing. Ask us to take it down and we will.
Intellectual property
The text, images, layout and code on this site, and the WINGOMART name and logo, belong to us or to our licensors. You are welcome to browse, buy and link to the site. Copying the content for commercial use requires our written permission.
Links to other sites
We sometimes link to sites we do not control. We are not responsible for their content or their privacy practices.
Personal information
What we collect and what you can ask us to do with it is set out in our Privacy policy.
Changes to these terms
We can update these terms. The version in force is the one posted here, with the effective date at the top. Changes apply to orders placed after that date, not to orders we have already accepted.
Applicable law and where a dispute is heard
These terms, and any purchase made through this site, are governed by the laws in force in Quebec, Canada.
If you are a consumer, you may bring an action in the judicial district where you live. Nothing in these terms requires you to sue anywhere else. There is no mandatory arbitration clause here and no waiver of any recourse: the choice of going to court, including the Small Claims Division, stays yours. Talking to us first is usually faster - most problems are settled by email.
If part of these terms does not apply
If a court finds one part of these terms invalid or unenforceable, that part is removed and the rest continues to apply.
